Haryana gangster encounter: Register FIR against Gurgaon cops, says Bombay HC

The Bombay High Court Monday ordered registration of an FIR against members of the Gurgaon police team who shot Haryana gangster Sandeep Gadoli in an alleged shootout at a suburban Mumbai hotel on February 7.

The high court was hearing a petition filed by Gadoli’s brother, Kuldeep Singh, seeking that Mumbai police be directed to file an FIR against the Gurgaon police. Singh claimed Gadoli was “murdered” by the Gurgaon police at the behest of his business rival and Gurgaon politician Binder Gujjar.

Mumbai police will file the FIR after studying the court order, said a senior police officer. “Based on the statements of the family and the order we will decide what sections should be invoked. The brother, Kuldeep, will be recording his statement at MIDC police station tomorrow,” added the officer.

Public prosecutor Sandeep Shinde, who is representing the Mumbai police and the state government, said the high court ordered an FIR be registered and dismissed the petition. “Charges of murder have been invoked in the open FIR, the matter will be probed by the Mumbai police,” added Shinde.

Kuldeep, meanwhile, has also alleged outside the court that an officer who was earlier the in-charge of the Gurgaon police crime unit had threatened their family some time ago that Gadoli would be killed. “The officer is close to Binder Gujjar. So, my brother ran away to Mumbai, but the Gurgaon police went after him because they had taken “supari” from his rival,” alleged Kuldeep.

Infamous as Gurgaon’s most wanted, Gadoli was involved in 36 serious offences including murders, according to Gurgaon police. He was also involved in the killing of the driver of gangster turned ward councillor Binder Gujjar in October last year, said the police.

A day after the alleged shootout in the Mumbai hotel, an FIR was registered by MIDC police. The complainant, Gurgaon police sub-inspector (SI) Pradhuman Yadav, who led a team of eight personnel to Hotel Airport Metro, alleged Gadoli fired at his men and died in the counter attack. Hence, Gadoli was booked under attempt to murder charges.

A Gurgaon police officer who did not want to be named dismissed all allegations against the police team involved in the alleged shootout. “All doubts will be cleared once the eyewitness records her statement,” said the officer, referring to a woman who was with Gadoli in the hotel on the day of the alleged shootout. “We informed the Mumbai team about the sequence of events. We did our duty and cannot be put to test for killing a gangster. We followed all procedures,” added the officer. Gadoli’s sisters have alleged Gurgaon police used the woman, suspected to be his girlfriend, to track him.

Gurgaon police commissioner Navdeep Singh Virk did not respond to messages and calls for comment.Gadoli’s sisters, Sudesh Kataria and Jyotsna Gulia, have been camping outside Mumbai’s JJ Hospital, refusing to take his body till a fair probe is instituted into his death. “We will not bring back the body to Gurgaon till an FIR is registered against the Gurgaon police and they are booked for the cold-blooded murder. We want justice for our brother. Till then, we won’t claim his body from the JJ mortuary,” said Kataria.
