Delhi Law and Justice Minister Atishi has debarred the standing counsel of the Services Department for allegedly giving “wrong” information on behalf of the government in an affidavit submitted in the High Court. The Minister has also directed Chief Secretary Naresh Kumar to conduct an inquiry.
In an order issued to the Department, Atishi said, “Whereas, it has come to light that … Standing Counsel (Services), who is not the Standing Counsel (Civil), while appearing for GNCTD (Government of National Capital Territory of Delhi) … before the High Court on July 1, has given false and untruthful statements and has submitted wrong information in the affidavit filed before the Hon’ble Court,” said Atishi.
The order also read, “It has also been brought to my attention that he has given a wrong legal opinion in another matter before the High Court in (a) contempt case…while appearing for GNCTD and Health Department despite not being the Standing Counsel (Civil).” Ahlwat was unavailable for comment on the matter.
“Since it is abundantly clear that Ahlawat misled the court by misrepresenting facts, submitting wrong information, and furnishing incorrect legal opinion, which amounts to grave misconduct, the Chief Secretary has been directed to conduct an inquiry,” Atishi said.
In the meantime, Santosh Kumar Tripathi, Standing Counsel (Civil), shall represent the GNCTD in all relevant matters in place of Avnish Ahlawat, said the Minister.
The order has been marked to all the additional chief secretaries, principal secretaries, secretaries, and HODs of all Delhi government departments and also to the secretaries to the ministers.
