The three commissioners of the Municipal Corporations of Delhi (MCD) have been sent legal notice for providing official vehicles to Leaders of House and Leaders of Opposition of the three civic bodies. The three commissioners — Manish Gupta, V K Gupta and Kumaraswamy — have been a given a month to reply to the notice.
Petitioner Subodh Jain accused the MCDs of misusing taxes paid by the people of Delhi to provide “luxuries” to elected members.
According to DMC Act, 1957, only the mayor is eligible for an office and an official vehicle. The notice, also sent to the chairman of local bodies and the Lt-Governor, questions the need for employees to be provided to these officials, including support staff and drivers.
“The original Act does not mention the positions Leader of House and Leader of Opposition. As such, only the mayor and the chairman of the Standing Committee are eligible for official vehicles,” Jain said.
Leader of Opposition in the South Municipal Corporation Farhad Suri does not use an official car. He said such a provision did not exist, but a resolution could be passed in the House for the same.
The notice states that Leader of the Opposition of the East Municipal Corporation had moved a “Private Member Resolution” in the Standing Committee to provide vehicles to the Leader of House and the Leader of Opposition, which was subsequently passed by the House. Jain said the resolution was then moved and passed in the North corporation to allow cars for both leaders.
