Can permanent committee hold fresh assessment of lawyers, SC asks Delhi HC

The Supreme Court on Friday sought to know from the Delhi High Court whether a fresh assessment of lawyers, whose applications for senior designations were rejected or deferred, can be conducted by its permanent committee.

A bench comprising Justices Abhay S Oka and Ujjal Bhuyan asked senior advocate Rajshekhar Rao, who appeared on behalf of the HC, to get instructions on this.

Rao said that the Full Court of the HC can re-consider the rejected and deferred applications. But the petitioner counsel questioned the preliminary assessment done by the committee, following which the bench asked Rao if the exercise can be done afresh from the stage of the committee.

“So, you must take instructions that in case of rejected candidates and deferred candidates, whether the process will be conducted from the start from the markings by the permanent committee,” said Justice Oka.
