Vigilance seeks probe against Haryana IAS officer in Rohtak land release case

The Haryana State Vigilance and Anti-Corruption Bureau (SV & ACB) has sought the state government’s permission to investigate the role of IAS officer Mohammad Shayin and a revenue official in the alleged illegal release of a land parcel of nine marlas from the acquisition process in Rohtak in 2007.

In 2007, Shayin, a 2002-batch IAS officer, was serving as the administrator of the Haryana Urban Development Authority (HUDA), now known as the Haryana Shehri Vikas Pradhikaran.

In a probe report sent to the state Chief Secretary recently, the ACB has requested approval to probe the role of Mohammad Shayin and patwari Jagbir under Section 17 A of the Prevention of Corruption Act, 1988.

According to the ACB, the land was released based on an agreement signed in July 2007 between the then HUDA administrator Mohammad Shayin and Rohtak resident Satish Kumar, even though “the land was earmarked for a 45-metre-wide main road and a 12-metre-wide service road”.

The ACB alleged that the release was granted based on an official letter dated November 2006, even though the specific details of the land parcel in question were not mentioned in the document.

The ACB report notes that following the release of the land parcel, Satish Kumar deposited Rs 40,556 as External Development Charges (EDC) in January 2008, casting doubt on the legitimacy of the process. It also highlights the involvement of the then land acquisition officer and officials of the revenue department and HUDA in the matter. The report points out that the land measurement was incorrectly carried out, and the parcel was subsequently sold by Satish Kumar.

In 2018, HUDA administrator Virender Singh annulled the agreement between Mohammad Shayin and Satish Kumar. In his order, Singh stated that Satish Kumar’s land was not included in the official list of plots approved for release from the acquisition process at Sectors 4, 5, and 6 in Rohtak.

The ACB alleged that officials, in collusion with the landowner, and by misusing their official positions, conferred undue benefit upon the owner and caused a financial loss to the government.

The ACB recommended registration of an FIR under sections 409 (criminal breach of trust), 420 (cheating), 467 (forgery), 471 (using forged document as genuine), 120B (criminal conspiracy), and 201 (causing disappearance of evidence) of the Indian Penal Code (IPC), along with applicable provisions of the Prevention of Corruption Act. The report also mentions that some of the officials found involved in the case have since retired from government service.
