Suman,the victim of wrong blood transfusion at Government Multi-Speciality Hospital (GMSH),Sector 16,has decided to appeal in the National Consumer Disputes Redressal Commission,New Delhi,against the order of the UT Consumer Disputes Redressal Commission. The wrong transfusion caused the death of her nine-month-old foetus and major health problems for her.
Suman is demanding enhancement of the compensation awarded by the Commission. In its order delivered last week in the case,the UT Consumer Commission had directed GMSH and the other three accused to jointly and severally pay Rs 4 lakh as compensation to Suman,along with Rs 50,000 as litigation costs. The accused in the case are GMSHs lab technician Kirti Sood,intern Dr Navdeep Kaur and house surgeon Dr Manpreet Kaur.
The doctors indicted by the UT Commission are also planning to file an appeal in the National Commission against the judgement. Counsel for the intern Dr Navdeep Kaur said the National Consumer Commission must consider that as an intern,no case of negligence can be foisted on her. The Graduate Medical Education Regulations of Medical Council of India (MCI) are clear in this regard. Dr Navdeep cannot be considered an opposite party in the case, he said. The other doctors too are likely to appeal against the judgement.
Speaking to Chandigarh Newsline,Suman and her husband Desraj said that Rs 4 lakh is not enough to compensate them. They said the compensation must be enhanced keeping in view the pain caused to them by the death of their unborn child and the severe health problems caused to Suman following the wrong transfusion.
The couple reside at Colony Number 4,a slum in Industrial Area Phase I.
