The Karnataka High Court on Tuesday stayed the Central circular asking states to ensure no licenses or permissions are issued for the sale, breeding and keeping of pit bulls and other breeds which are ‘dangerous for human life’ in the Southern state.
The circular dated March 12 from the Union Ministry of Fisheries, Animal Husbandry and Dairying had also directed that existing pet dogs of those breeds would have to be sterilised.
The Tuesday order was passed by a single-judge bench consisting of Justice M Nagaprasanna on a petition filed against the circular by breeder King Solomon David.
As the Karnataka Deputy Solicitor General stated before the High Court that the circular was based on a Delhi High Court order, Justice Nagaprasanna observed that the Delhi order had directed that all stakeholders should be consulted.
Justice Nagaprasanna said, “According to the learned counsel for the petitioner…the Kennel Club of India has not been heard. They are the only certifying kennel club… the High Court of Delhi had observed that all stakeholders shall be consulted, not a few or various”.
Justice Nagaprasanna then passed a stay order on the operation of the ban circular within Karnataka till the documents were produced showing the decision-making behind the circular.
