Gujarat HC dismisses plea seeking removal of blanket ban on gaming zones

The state had closed all gaming zones following the fire in the TRP Gaming Zone and the order had recorded the same, with a direction that the gaming zones would remain closed until further orders.

According to the applicant, they were permitted to organise a fun fair event in Ahmedabad from May 9 to June 9 with permission from requisite authorities including the permit to fix the event’s entry fee by Joint Commissioner of Police in the city. However, it was halted following the Rajkot fire incident.

According to the applicant they have submitted an application for the extension of permission before the competent authority but there has been no development to the authorities’ end owing to the HC order, which was passed suo motu.

The bench recorded that the application was “misconceived” and held that the court’s direction is not an impediment as it did not qualify as a gaming zone.
Additionally, the court also recorded that the state has proposed actions against the applicant firm and closed their events on the account of violation of statutory conditions/ guidelines for running such activities.
