The Narmada District Sessions court on Wednesday rejected the bail plea filed by Dediapada AAP MLA Chaitar Vasava, stating that “no new ground” has come forth to change the earlier decision of rejecting the bail application.
Chaitar, who completed his three-day temporary bail to attend the monsoon session of the Gujarat Assembly on Wednesday, had withdrawn his plea from the High Court earlier this week as the police filed the chargesheet in the case in Narmada.
Public Prosecutor Jitendrasinh Gohil said in the court on Wednesday that following the filing of chargesheet by the Dediapada police station in the July 5 case of alleged attempt to murder filed by BJP leader Sanjay Vasava, Chaitar Vasava moved a fresh regular bail plea before the Narmada Sessions Court.
Chaitar had withdrawn his bail plea, which was to be heard on September 11, from the Gujarat HC as the petition was filed before the filing of the chargesheet by the police.
On Wednesday, Additional Sessions Judge of Narmada AV Hirpada said that the plea had created “no new ground” to be considered. Gohil said, “The court was of the view that except for the filing of chargesheet, there is no reason for the court to go back on its earlier decision to reject the bail application, which was filed in August. As per procedure, since the chargesheet has been filed, he withdrew his plea from the HC, which was filed before the chargesheet. Chaitar can now move a fresh bail plea before the HC.”
The prosecution had opposed the bail plea even as Chaitar’s lawyers put forth precedent of the Supreme Court and High Court granting bail in other cases. The court also noted that the videos of “inflammatory media statements” made by his supporters as well as videos of the speeches of AAP leaders and Chaitar’s wife reading out a letter, written by him from jail, in a rally of the party’s National Convener Arvind Kejriwal in July had supported the reason of the prosecution to deny bail to the legislator.
