May 8: The Supreme Court today rejected the Special Leave Petition filed by the slum-dwellers of the Sanjay Gandhi National Park (SGNP) seeking a stay on the on-going demolition. A division bench of Justice B N Kirpal and Justice Kadri refused to hear the petition filed by Ram Prasad Sharma and other residents of Ketkipada, Dahisar, asking for a stay on a Bombay High Court order, which states that even slums pre-dating 1995 should be razed if the residents have not paid the requisite sum for rehabilitation. The thus continue unabated.

Senior counsels F S Nariman and S R Grover had argued before the court that the high court order was against Article 21 of the Constitution, which guarantees life and liberty. They also said that it was not feasible for slum-dwellers from Borivli to shift to places like Kalyan and Ambarnath.

The bench, though, refused to consider the arguments. The state government might have no option left but to amend the notification fixing the limits of the SGNP.
