Averting a crisis of sorts with firmness, a highly embarrassed and anguished Supreme Court has severely chastised the Patna High Court and expunged the latter’s ‘‘derogatory, disparaging and totally uncalled for’’ remarks against the highest court.

This was the first instance where the propriety of an order of the Supreme Court was questioned by a high court, that too in a judicial order, taking affront to the apex court’s query about proceedings on certain applications. A bench of Justice R.C. Lahoti and Justice Ashokbhan, while expunging certain observations in the HC order on December 3, last year, said: ‘‘Our embarrassment stands multiplied when we notice that the division bench of the high court, which passed the order, was headed by the Chief Justice of the high court.” The SC had asked details of the hearing of certain applications as a grievance was made out before it that these applications were not being heard by the high court despite directions from the SC. When the matter was placed the before the HC, the judges of a division bench took it on the judicial side and strongly deprecated the order of the SC seeking information and termed it as a ‘‘sad day for judiciary”. — (PTI)
