Defence ministry to go to SC against HC review of AFT orders

The AFT has also been seeking 'contempt of court' powers for getting its orders implemented.

The Defence Ministry is palnning to file a plea in the Supreme Court against the Delhi High Court verdict allowing itself to review the decisions of the Armed Forces Tribunal.

“We have consulted the Law Ministry and we wanted to move for an appeal. Very soon we should move to the Supreme Court,” Defence Minister A K Antony told reporters here.

The Defence Minister was reacting to a query about the Delhi High Court hearing a number of cases on which the Tribunal has already taken a decision.

As per the AFT Act,rulings and verdicts of the AFT can be reviewed only by the Supreme Court.

The AFT was formed for quick redressal of grievances and judicial review of court martial orders with just one-stage review (Supreme Court in this case) for armed forces personnel.
