HC seeks govt reply to allegations over CLB member appointment

The Delhi HC issued a notice to the government seeking a reply to a petition which alleged that it appointed Vimala Yadav as a member of the Company Law Board who did not have the required qualifications.

The Delhi High Court on Wednesday issued a notice to the government seeking a reply to a petition which alleged that it appointed Vimala Yadav as a member of the Company Law Board who did not have the required qualifications.

A division bench comprising Chief Justice A P Shah and Justice Manmohan issued the notice directing the government to file its reply to the allegations.

In its petition,one Sanjeev Manchanda alleged that Vimla Yadav was appointed as technical member under the reserved category “without having prescribed knowledge and experience in the company matter” and was posted at its principal bench at New Delhi.

Manchanda further submitted as per the information he got through RTI that “Vimla Yadav,an Indian Revenue Service officer and OBC candidate … was not satisfying the conditions of the adequate knowledge and experience in dealings with the problems relating to the company law”.

Yadav was selected as member in 2005 by the selection committee headed by then Supreme Court judge Justice M Santosh Hegde “by giving complete go bye to the Company Law Board (Qualifications,experience and other conditions of service) Rules,1993”.

The petitioner requested the court to “quash the appointment of Vimla Yadav” saying her appointment was “illegal,bad in law and null void.”
