Delhi Chief Minister Arvind Kejriwal, Deputy CM Manish Sisodia and 11 other AAP MLAs were granted bail by a Delhi court Thursday in connection with the alleged assault on Chief Secretary Anshu Prakash.
Last month, Additional Chief Metropolitan Magistrate (ACMM) Samar Vishal had taken cognizance of the offences in the chargesheet and had summoned all the accused today.
The alleged assault took place on the intervening night of February 19 and 20 at Kejriwal’s residence, when Prakash was called for a meeting. A case was registered on Prakash’s complaint, who had alleged that he was assaulted by AAP MLAs. Apart from Kejriwal and Sisodia, MLAs Amanatullah Khan, Prakash Jarwal, Nitin Tyagi, Rituraj Govind, Sanjeev Jha, Ajay Dutt, Rajesh Rishi, Rajesh Gupta, Madan Lal, Parveen Kumar and Dinesh Mohaniya have been named as accused in the case.
In its 1,300-page chargesheet, police had charged all the accused, including Kejriwal and Sisodia, under the same 13 IPC sections. In February, police had lodged a case under eight IPC sections, but added five more sections in the chargesheet. ACMM Samar Vishal, however, did not take cognizance of IPC section 504 (insult with intent to provoke breach of peace).
“I have gone through the chargesheet and documents filed along with it… There are sufficient grounds to proceed against the accused… Let these accused be summoned through IO for October 25,” the ACMM had earlier said.
