Man accuses in-laws of torture,High Court quashes plea

The Bombay High Court quashed an FIR filed by a businessman against his parents-in-law under the IPC 498.

The Bombay High Court on Monday quashed an FIR filed by a businessman against his parents-in-law under the IPC 498,otherwise mostly used by women who allege torture by husband or in-laws.

In a one-of-its-kind case,35-year-old Manoj Kumar Sharma tried using the law through the means of a private complaint against his in-laws alleging his wife was abducted from his house in Kurla,while he was away at work.

The case dates back to 2006. Sharma,a businessman from Uttar Pradesh,fell in love with the sister of one of his employees,Pradeep Pathak. He and the girl,Neelam,decided to tie the knot soon. However,soon after the engagement,the relationship soured after Pradeep Pathak and Sharma picked up a fight over work. The engagement was called off. However,Sharma finally convinced Neelam to elope with him to Mumbai and married her. “A year into the marriage,the relations soured and Neelam left the house. She admitted this to the Judge in a personal interview. She claimed Sharma had filed a complaint to blackmail her to return,” said her counsel Ayaz Khan.

Sharma’s complaint with the Kurla police landed Pradeep in jail for two months after which the family bailed him out. The police had booked the family under several sections of the IPC.

Neelam’s parents—Satyanarayan Pathak (50),Snehalata Pathak (50)—along with Pradeep had appoached the High Court alleging the case was fake. Justice V K Tahilramani on Monday quashed the complaint against all the family members.
