THE BOMBAY High Court on Monday dismissed a PIL challenging the implementation of the Mukhya Mantri Majhi Ladki Bahin Yojana—the state government’s ambitious scheme where Rs 1,500 will be transferred into the bank accounts of eligible women aged between 21 and 65 every month.
A bench of Chief Justice D K Upadhyaya and Justice Amit Borkar said it was a policy decision of the government which the court cannot interfere in, unless there is a violation of Fundamental Rights. The court said it was a beneficiary scheme for women and asked the petitioner how it can be termed discriminatory.
The petitioner, a CA from Navi Mumbai, had said in his plea that the government scheme put an additional burden on the taxpayers and that such schemes are synonymous to bribery or gifts to voters.
The court also said that the scheme was announced through the state budget, which is a legislative process, as part of a social welfare measure and that the court cannot fix the priorities of the government.
The petitioner had also said that the taxpayers’ taxes are collected for infrastructure development and not for such schemes. The court said that paying tax is compulsory and one cannot say how it needs to be used.
The plea had also sought quashing of a government resolution (GR) regarding Mukhyamantri Yuva Karya Prashikshan Yojana, an internship scheme for unemployed youth in Maharashtra, of July 9. The petition was dismissed.
