Fire NOC granted to Tardeo high-rise, regularisation application being considered, HC told

The Bombay High Court on Tuesday was informed that BMC has granted fire-NOC (no objection certificate) to a 34-storey high-rise in Tardeo in south Mumbai and the civic body was considering a regularisation application by the housing society.

The HC was also informed that the occupants of the top 18 floors of the building had vacated their premises as per a court order
A division bench of Justices Girish S Kulkarni and Arif S Doctor was hearing Willingdon View Cooperative Housing Society’s plea pertaining to the high-rise occupied by 50 flat purchasers of a total of 62 flats.

The HC on August 6 had “unwillingly” and on “humanitarian considerations” granted three more weeks to occupants of the top 18 floors of the building to vacate their premises at their own risk and face consequences in case of any untoward incident.

The HC had clarified that occupants of 17 to 34 floors “would be entitled to occupy the tenements, only after OC is granted” and had also raised concerns over no fire-NOC for the entire tower.

Representing the society, senior advocate Girish Godbole on Tuesday informed the HC that it got NOC from the Fire department. He also said that as per court order, the occupants of floors 17 to 34 had vacated their premises without Occupation Certificate (OC) at the end of August.

The Court also sought to know Brihanmumbai Municipal Corporation (BMC)’s stand on the legality of the first 16 floors, which it will consider during the next hearing.

Senior advocate S U Kamdar for BMC submitted that it had received a regularisation application from the society and the same was being considered. The court took the submissions on record and disposed of the interim application by the society.
