Sunjay Kapur assets case: Delhi HC allows Priya to file list of assets in sealed cover, all parties agree not to leak details

Priya filed the application in a partition suit moved by Sunjay’s children from his second marriage to actor Karisma Kapoor.

The Delhi High Court Friday allowed former Sona Comstar chairman Sunjay Kapur’s wife, Priya, to file the late businessman’s list of assets in a sealed cover, even as the parties locked in dispute in the partition suit said they would not leak the details to the press.

The court also recorded that the will of Sunjay and the list of assets, as furnished by his widow Priya, in a sealed cover before the court, will be used discreetly by all parties involved.

Justice Jyoti Singh, while dealing with the request by Priya for adding a confidentiality clause for the lists of assets and Sunjay’s will, did not issue any directions for adding a confidentiality club or a media gag.

Justice Singh also directed that a copy of the will be supplied to Sunjay’s mother, Rani.

In an application to the Delhi HC, Priya urged the court to permit her to submit the details in a sealed cover, accompanied by a confidentiality clause. Priya filed the application in a partition suit moved by Samaira and Kiaan Kapoor, Sunjay’s children from his second marriage to actor Karisma Kapoor. The two children have demanded a share in his estate, and raised suspicion over the genuineness of Sunjay’s will.

On Thursday, Justice Singh stated orally that the issuance of any such order could be “problematic,” as it would impinge on the parties’ right to question or verify the assets disclosed. The court also sought judicial precedents for any such order of sealed cover submission of disclosure assets.

On Friday, Senior Advocate Mahesh Jethmalani, appearing for the Kapoor children, objected to Priya’s request. “There can’t be a media gag like this…both sides have been talking about the case.”

Subsequently, all parties agreed to refrain from leaking details about the case.
