Delhi HC seeks Govt’s response over not approving payment proposal for arrears to law researchers from 2022

The Delhi Government Tuesday informed the Delhi High Court that it has approved a raise in the remuneration of law researchers, effective prospectively, despite the court’s 2022 order directing the hike to Rs 80,000, to be effective from October 1, 2022.

The prospective application would mean they would not be eligible for arrears.

Taking note of the High Court’s 2022 direction, a bench comprising Justices Prathiba Singh and Rajneesh Kumar directed the additional chief secretary of the Finance Department of the Delhi Government to file a response regarding the retrospective applicability.

The bench orally asked the Delhi Government why the hike would not apply retrospectively, since on previous occasions it had agreed to do so.

Reetesh Singh, Principal Secretary (Law), Delhi Government, informed the bench that a proposal had been presented to the Cabinet, but the Finance Department had raised an objection.

The court has now sought a response from the additional chief secretary of the finance department, noting that in the past, when similar enhancements of remuneration were made, it was in the terms of the recommendations made by the High Court’s Chief Justice.

The court posted the matter for consideration on October 10.
