The Karnataka High Court Monday reiterated that the Bruhat Bengaluru Mahanagara Palike (BBMP) must file an affidavit regarding the issue of pothole maintenance and road conditions.
A division bench of Acting Chief Justice Kameswar Rao and Justice CM Joshi was hearing a PIL filed in 2015, on which the court had earlier issued directions in September 2024. The PIL was filed by a group of residents from Koramangala regarding work contracts on roads, calling for the display of these contracts online, the creation of policies for awarding contracts, and the inclusion of accountability clauses. It also called for compensation for victims of accidents caused by potholes, along with implementing recommendations by recognised national agencies for pothole repair.
In the hearing, the petitioner’s counsel highlighted the delay in this case. At the same time, the BBMP sought two weeks for compliance with another direction issued by the court in September 2022, in which the court observed that no satisfactory progress had been made regarding the removal of encroachment in stormwater drains in a status report.
The September 2024 order passed by then Chief Justice N V Anjaria and Justice K V Aravind provided directions regarding the affidavit sought by the high court. The bench had stated, ” This petition was filed in the year 2015. The earlier reports filed on behalf of the respondent-Bruhath Bengaluru Mahanagara Palike (BBMP) do not disclose the latest position in terms of the steps taken by BBMP to deal with the issue of dilapidated roads and potholes.”
“Therefore, it is directed that the BBMP shall file a detailed affidavit, in which it shall be shown as to what mechanism the BBMP adopts every time and every year to deal with the problem of potholes and to maintain good condition of roads to enable smooth pedestrian and vehicular traffic,” the court had said.
The court had also ordered the inclusion of details regarding road and pothole repair during the monsoon, as well as the point raised in the petition regarding the payment of compensation to victims of pothole accidents.
