BBMP to auction properties of chronic tax defaulters to recover dues

In a crackdown over long-pending property tax arrears, the Bruhat Bengaluru Mahanagara Palike has decided to auction immovable properties of chronic defaulters. It will conduct the auction under section 156(5) of the BBMP Act 2020, as property owners have failed to clear their dues despite multiple notices and enforcement actions.

According to BBMP officials, defaulters were given ample opportunities to settle their arrears through the issuance of showcause notices, demand notices, and property attachment orders. In the case of non-residential properties, sealing measures were also undertaken. However, since these efforts did not yield results, the civic body has resorted to auctioning the properties as a final step to recover the pending dues.

For example, M Rangappa has not cleared dues amounting to Rs 1.85 crore for his property with a land area of 9,090 sq ft and a built-up area of 44,933 sq ft, located in the Dasarahalli zone. Similarly, Shankare Gowda owes dues amounting to Rs 30 lakh for his property in the Dasarahalli zone, Kumar M has pending dues of Rs 31 lakh for his property in the Bommanahalli zone, and Mohammed Ishaq owes Rs 11 lakh to the BBMP for his property in the East zone.

As per the auction process, the highest bidder will gain the right, title, and interest in the immovable property. The successful bidder must deposit 1 per cent of the final bid amount on the day of the auction, followed by 24 per cent within three days. The remaining 75 per cent must be paid within 15-30 days, depending on the total amount. If the final sale price exceeds the outstanding amount owed to the BBMP, the excess will be credited to the property owner’s bank account.

Munish Moudgil, Special Commissioner (Revenue), BBMP, said that notices had been issued to 8-10 top defaulters across the city, with one or two cases identified in each zone. The auction dates have been fixed and the sale will proceed for properties categorised as chronic non-payment cases.

“This is just the beginning. More properties, both commercial and residential, will be put up for auction every week to ensure the recovery of property tax arrears,” Moudgil said.

According to the civic body, officials identified 206,753 property tax defaulters in early January, with pending dues amounting to Rs 329.15 crore. In the past week alone, Rs 3.69 crore was recovered, 203 non-residential properties were sealed, and 180 properties were attached for non-payment.
