There seems to be something radically wrong with our judiciary. The Supreme Court judgment upholding Section 377 was regressive enough. Now, a Delhi court has stated in a judgment that pre-marital sex is immoral and not permitted by any religion (‘Pre-marital sex immoral, no religion permits it, says fast-track court judge’, IE, January 6). Judges are expected to interpret and enforce the provisions of the statute and not depend on theology. If this is how learned judges deliver justice, the precept of separating religion and administration stands violated.
