Police documents say the shooting happened on 14 November on the 215 Southern Beltway near Gibson Road, following a road-rage confrontation between Valente and the suspect, 22-year-old Tyler Johns.
In the footage, Johns admits firing the shot. He tells officers: “I shot at him, I didn’t know there was a kid in the back.” He later adds: “It’s 100% my fault, I shot at him. I didn’t know that he had a kid in the car.”
Police said the incident took place at around 7:30 a.m. on Friday when two cars began trying to pass each other on a congested freeway. Both drivers rolled down their windows and argued.
Johns, who was driving a four-door sedan, allegedly fired one round at an SUV driven by the boy’s stepfather, Valente Ayala. The shot struck 11-year-old Brandon Dominguez-Chavarria, who was seated in the back.
Ayala then rammed Johns’ vehicle to stop him from leaving. Both vehicles came to a halt, and an officer driving by intervened. Two witnesses then opened the back door of the SUV and found the child “slumped over” with heavy bleeding, ABC News reported from the arrest declaration.
Johns “admitted to officers that he had discharged his firearm” and said he “did not know there was a kid in the back,” according to ABC News.
The boy was taken to hospital but died from a gunshot wound to the head, the Clark County Coroner said.
Johns’ lawyer told the court that Ayala’s driving made Johns raise his gun, saying the suspect had not intended to shoot. The lawyer said Johns did not know a child was in the car because the stepfather was “driving in that particular manner,” ABC News reported.
The boy’s mother, Rubi Chavarria, asked the court to deny bail, saying: “My son’s life was taken away, regardless if you saw him or not.” She added: “Road raging does not give you a right to shoot at anybody, even if you didn’t see a child in the back.”
“What if he does this to somebody else?” she said. Johns is due back in court on 4 December.
