Zakia Jafri, the widow of former Congress MP Ahsan Jafri who was killed in the Gulberg Society massacre along with 68 others during the 2002 riots, filed a petition before a metropolitan court here Monday challenging the closure report submitted by the Supreme Court-appointed Special Investigation Team (SIT) that gave a clean chit to Chief Minister Narendra Modi and 62 others.

The petition submitted along with three volumes of annexures and 10 CDs accuses the SIT of “covering up crimes…misguiding court and giving a clean chit to the accused” while demanding a further probe by an independent agency. Most of the evidence annexed in the petition has been taken from SIT’s voluminous probe report which Jafri obtained after a prolonged legal battle.

Citing SIT papers, the petition claimed that the state intelligence bureau had forewarned the government of kar sevaks on Sabarmati Express calling for revenge after the S-6 coach was set afire.

Jafri’s lawyer S M Vora told The Indian Express,“The evidence is all with the SIT,which it interpreted to its convenience.” Jafri appeared before the court accompanied by her relatives, activist Teesta Setalvad of Citizens for Justice and Peace, and a battery of lawyers.

After the petition was submitted, metropolitan magistrate B J Ganatra ordered to case to be heard on daily basis from April 24 onwards. The plea also annexes police control room messages and intelligence inputs that detail the build-up of communal passion and advise preventive action.

The SIT had filed 20,000-page closure report before this court in February last year after probing Jafri’s complaint that accused Modi and 62 others for complicity in 2002 riots. In its report,SIT had said it had found no evidence to support her allegations while recommending departmental action against some of the officers for failing to discharge their duties.

In a press release by Citizen for Justice and Peace claimed that Jafri’s petition filed on Monday cited SIT documents on how administration and policing were allegedly deliberately paralysed.
