A local court in Surendranagar on Monday sentenced a rape convict,who had assaulted the districts principal judge four months ago,to three years of rigorous imprisonment. The court of PJ Danger,chief judicial magistrate (first class) of Surendrangar,convicted Sanjay Devthariya of attacking principal district judge A D Mogal under IPC Sections 332 (voluntarily causing hurt to deter public servant from his duty),353 (assault or criminal force to deter public servant from discharge of his duty) and 186 (obstructing public servant in discharge of public functions). The court also imposed a fine of Rs 3,300. In case of failure to pay the fine,Devthariya will have to spend three additional months in jail.
Devthariya (27),already serving 10-year term for raping a married woman in his village Nana Kerala in Wadhwan taluka of Surendranagar pleaded both his sentences run parallel. However,the court rejected his plea,saying his action deserved exemplary punishment and pronounced that the rigorous imprisonment will be over and above the 10-year term that he has been serving, assistant public prosecutor Tulsi Damor told The Indian Express.
Devthariya has been lodged in Rajkot Central Jail and was present in the court when the judgment was pronounced. The court relied on testimonies of witnesses.
