While the lone surviving terrorist of the Mumbai attacks,Ajmal Amir Kasab,hasn’t received any legal aid as yet,on Monday advocate Ejaz Naqvi filed his vakalatnama for one of the accused of the terror attacks,Fahim Ansari. Metropolitan Magistrate R V Sawant Wagule handed over Fahim Ansari and Sabahuddin Ahmed to crime branch custody till January 23 for their alleged connection with the Mumbai terror strike.

A case registered with the Colaba police station states that Ansari and Ahmed were allegedly aware of the conspiracy and the map prepared by Ansari was used by the attackers. “The police need to interrogate if both the accused had prior information about the attack and if they aided the terror strike,” public prosecutor Eknath Dhamal argued before the court.

Naqvi plans to file a writ petition challenging crime branch’s contention on Ansari’s role in Mumbai terror strike. He claims Ansari was wrongly implicated in the case and his case qualifies to be a double jeopardy case,where an accused is implicated more than once for an offence committed.

Naqvi took up Ansari’s case,after Ansari’s brother Abu Bakr approached him. “After contemplating for some time I decided to take up his case. Fahim has been made an accused on similar grounds in the CRPF case. The crime branch is again asking for his custody on the same ground. No accused can be booked for same charges in two different cases,” said Naqvi,who has been practicing in the Bombay High court for the past five years.

Ansari and Ahmed were arrested in February last year in connection with the attack on the CRPF camp in Uttar Pradesh. Both the accused were brought to Mumbai from Lucknow on December 18 last year.
