The J&K High Court on Tuesday stayed the demotion and transfer of S S Sandhu,IG (operations) of CRPF in the valley,after he filed a writ petition challenging the Home Ministry order.
On April 3,the ministry had issued demotion orders against Sandhu on the grounds of lack of physical fitness for the post of IG,CRPF. The officer was posted as DIG,CRPF,at the New Delhi headquarters and a new officer was posted in his place. It was for the first time in the history of CRPF that a senior officer was demoted on grounds of his physical fitness.
But instead of taking up the new posting,the officer moved the HC. After admitting his petition,Justice Mohammad Yaqoob Mir said that demotion and consequential appointment orders of Sandhu have been put in abeyance for two weeks.
The court has asked the Home Ministry to file its objections. In his plea,Sandhu had termed the Home Ministry order as arbitrary,invidiously discriminatory and in violation of his Constitutional guarantees granted under Article 311 (2).
The ministrys order was based on recommendations of a doctors panel who had examined Sandhu and found him ineligible for promotion.
In September,Sandhu had challenged a similar decision of the medical board set up by the ministry and got a decision in his favour. Then Sandhu was promoted as the IG.
