The Bombay High Court Monday directed the state government to file a comprehensive list of multiple allotment of flats under the Chief Ministers discretionary quota as per its December 11 order. According to the state governments reply,PWD minister Chhagan Bhujbal was allotted a flat under the MLA category in Pune, but the same was cancelled after he did not enter into the agreement within the prescribed time.
His nephew Sameer Bhujbal, however, was allotted a flat under the acute need for space category in Pune, which is according to the terms and conditions of the allotment, the governments reply says.
Wheres the compliance with the order (December 11)? Just see the last order passed by us. Your chart was defective, a division bench of Justice A S Oka and Justice S C Gupte told Advocate General Darius Khambata, who appeared for the state government. The court pointed out lacunae in the list submitted by the state in an earlier hearing, and said the government has to consider the allottees under the quota .
The state,in its reply filed through Urban Development Department Under Secretary Shriram D Yadav, stated that Labour Minister Hassan Mushrifs sons Abid and Sajid were allotted flats under the acute need category.
The bench was hearing a PIL by activist Ketan Tirodkar, who argued that the state had not furnished the list of beneficiaries under the 2 per cent quota made available from the flats constructed for general public by MHADA.
Observing that the state has sought time to comply with its December 11 order, the court adjourned the hearing to January 6.
