Chandolia out,now HC stays bail

However,Justice V K Shalis order is applicable if Chandolia is not released from Tihar Jail.

The High Court judge who has been hearing bail plea of Siddhartha Behura on Friday ordered a stay on the bail order of R K Chandolia,saying the latters release would affect the formers application.

However,Justice V K Shalis order is applicable if Chandolia is not released from Tihar Jail. Incidentally,Chandolia,the personal secretary to former telecom minister A Raja,was released late on Thursday night.

Justice Shali took suo motu cognizance of newspaper reports,which said Chandolia was a public servant. R K Chandolia is reported to be a member of the Indian Economic Service and a public servant. The decision on his application for grant of bail is going to have an impact on the bail application of Siddhartha Behura on which order has been reserved,apart from the fact,question arises as to whether the order of grant of bail was just,proper or arbitrary,or unreasonable having regard to the facts of the case and the allegations made qua him, noted the judge in his three-page order.

In the meantime,in case R K Chandolia has not been released on bail,there shall be a stay against operation of the said order of bail purported to have been passed on 01.12.2011 by the learned Spl. Judge,Patiala House Courts,till the next date of hearing, said the order.

The CBI has opposed former telecom secretary Behuras bail application,saying he is a public servant. Justice Shali concluded hearing arguments on the application and reserved his order on Thursday.

On Friday,the High Court also ordered that the special CBI court,that is hearing the 2G spectrum case,transfer all documents related to Chandolias bail application to it. Accordingly,the record of the bail application of R K Chandolia,the reply filed by the CBI,copy of the order or any other relevant documents,which the learned Spl. Judge considers it necessary,may be transmitted to this court, said Justice Shali.

However,the High Court exempted the transfer of those documents needed in the day-to-day hearing of the case,and issued notices to the CBI as well as Chandolia.

While granting Chandolia bail on Thursday,Special CBI Judge O P Saini had said he was only a private secretary while Raja and Behura were in decision-making positions.
