The Supreme Court on Monday censured the CBI for hoodwinking the due process while arresting BJP MP from Gujarat Dinu Bogha Solanki in connection with the murder of RTI activist Amit Jethwa. A bench comprising Justices S S Nijjar and F M I Kalifulla pulled up the CBI for arresting Solanki without first informing the apex court or placing requisite material before it,as per the courts order in March.
The court order had asked the CBI to continue its investigation into the case but said the result of the investigation should be placed before the court in a sealed cover.
It seems you are hoodwinking the procedure. You have now arrested him without adducing any material before us or moving the court of competent jurisdiction. Why did you not move the court before arresting him?, the bench asked the CBI counsel.
The CBI counsel replied that Solanki was arrested as some new information had come to light during the CBI questioning. Solanki,Lok Sabha member from Junagadh,was arrested on November 5. A Delhi court on November 6 had granted a two-day transit remand to CBI to take the arrested BJP MP to Ahmedabad.
Solanki sent to 14-day judicial custody
AHMEDABAD: A CBI magisterial court on Monday sent Junagadh BJP MP Dinu Solanki to 14-day judicial custody in Sabarmati Central Jail in connection with RTI activist Amit Jethwa murder case. The move came after CBI produced him before the court and didnt ask for further remand. The central investigating agency had accused Solanki of allegedly masterminding Jethwas murder in 2010 and hatching conspiracy. ENS
