In a relief to former Karnataka Chief Minister B S Yeddyurappa,the Supreme Court has dismissed the CBIs plea to cancel his anticipatory bail in an illegal mining case.
A Bench of Justices T S Thakur and Ibrahim Kalifulla also pulled up the CBI for approaching it without substantial grounds and rejected its contention that the Karnataka High Court had tied its hands by granting anticipatory bail to Yeddyurappa.
The HC had granted bail to BSY on June 21 on the grounds that allegations were not something new. The CBI pleaded the SC to cancel the bail saying Yeddyurappa was not cooperating with its investigation.
The court also said it cannot interfere since anticipatory bail could be cancelled only if the gravity of the case so demanded and if there was a possibility of the accused jumping bail.
