At a time when the BSP has suspended several of its MLAs for criminal activities and corruption, the UP police cant find two ruling party legislators against whom non-bailable warrants are pending in rape and murder cases.
While Haji Alim,MLA from Bulandshahar,is wanted in a rape case,Brijesh Saurabh,MLA from Pratapgarhs Gadwara constituency,is wanted in a case of murder.
A non-bailable warrant against Brijesh Saurabh is pending since August and against Haji Alim for more than a year. In both cases, the police have told courts that they cannot find the MLAs.
Haji Alim and his brother Haji Yunis, both history-sheeters,owned a circus. On June 5,2003,a Delhi-based NGO,Pravasi Nepali Mitra Manch, lodged an FIR with the Kotwali police station in Muzaffarnagar, alleging that boys and girls from Nepal were being forcibly kept at the circus. A case of wrongful confinement, criminal intimidation and causing hurt was lodged.
After the complaint, the police raided the circus and rescued 32 boys and girls. The state government transferred the investigation to CB-CID,which filed a closure report and gave the brothers a clean chit on December 30,2004.
But a court summoned the accused on an application filed by some of the victims. Four girls alleged molestation by Yunus and Alim and the circus staff, and one girl alleged rape.
More than a year ago,the Muzaffarnagar court issued warrants against the Haji brothers after they ignored summons.
Last week, the Bulandshahar police informed the court that the MLA and his brother could not be found when the police went to their residence with the arrest warrants. The court directed the police to produce the brothers before it on November 30.
Brijesh Saurbah, the other MLA,is an accused in connection with the murder of an advocate Raghuvendra Singh, who was shot dead in Antoo area of Pratapgarh on June 24,2005.
After the legal process was initiated, the trial of the case was shifted to Bhopal on the directions of the Supreme Court after one of the accused approached it. In August,a Bhopal court issued a warrant against Brijesh Saurabh. However, the Pratapgarh police reported that they could not find the MLA.
