Chandigarh’s prestigious Post Graduate Institute of Medical Education and Research (PGIMER) and one of its former eye surgeons have been ordered by the country’s apex consumer forum to pay Rs 3.5 lakh as damages to a child for negligently wounding his left retina during a minor eye surgery.
“We have detailed the extent of deterioration that was suffered by the child in his left eye,as a result of the surgery. We have seen the evidence of absence of professional concern and follow up measures that would be required to rectify the damage,” the National Consumer Dispute Redressal Commission said.
“Comparison of the relevant parameters before and after the surgery clearly shows the extent of damage suffered by the patient due to this surgery,” added an NCDRC bench of Justice V R Kingaonkar,while ordering PGIMER and its former eye surgeon Neeraj Sud to pay Rs 3.5 laks as damages to the child. The NCDRC ordered compensation for the child,setting aside the state consumer commission order,which did not agree that there was any negligence on the part of PGIMER or Dr Sud. The NCDRC ruling came on Bhatinda resident Barjinder Singh’s complaint,saying that his son had a minor congenital defect with his left eye being bit smaller than the right one. Singh added that except the minor difference in the physical appearance between the two eyes of his son,they had no other defect with the both eyes having normal (6/9) vision. He said he had consulted Dr J S Saini at PGIMER and was told that this physical deformity could be cured by a minor surgery aimed at lifting the lid of the left eye to make it of the same size as the other eye.
