TMC’s Mahua Moitra moves Supreme Court over late-night Bengal Circuit House eviction

Article 32 of the Constitution of India allows citizens to directly approach the Supreme Court to seek enforcement of their fundamental rights.

“This requires some comprehensive directions because it involves issues of federalism and it also requires an independent investigation. This has happened despite the High Court already passing protective orders,” the lawyer added.

Seeking an early hearing, Moitra’s lawyer said it “involves an important constitutional issue”.

Though the bench initially did not appear keen to entertain the plea, the CJI later said, “We will see”.

Moitra wrote in a social media post on August 14 that the Nadia district administration had asked her to leave the Krishnanagar Circuit House where she was staying. She also alleged that a crowd of BJP workers protested against her outside the circuit house that night.

Moitra also wrote to Lok Sabha Speaker Om Birla to inform him of the development. “A woman MP, staying alone, being asked to vacate her rightful accommodation at 9.47 pm not only gravely violates her rights, but brings into question the safety and security accorded to women by the ruling dispensation,” she said.
