Haldwani railway land encroachment case: Haldwani in Uttarakhand’s Nainital district was placed on high alert ahead of the Supreme Court verdict on the land encroachment matter that will decide the fate of over 50,000 residents.
The police and administration cordoned off the area to quell any attempt to disrupt peace.
The case pertains to encroachment of around 29 acres of Indian Railways land in three localities – Gafoor Basti, Dholak Basti and Indira Nagar. A total of 4,365 alleged encroachments were identified by the administration.

January, 2017: High court directs eviction of over 50,000 people. January, 2017: Supreme Court stays the high court order. May, 2022: The Supreme Court stays the High Court’s eviction order, citing concerns about 50,000 people being evicted overnight. December, 2022: High court directs Railways to give residents a week’s notice to vacate the land, authorising the use of force if necessary. December, 2022: The Supreme Court asks the affected individuals to present their case, but they failed to prove their ownership. January 2023: Supreme Court stays high court’s eviction order, citing concerns about 50,000 people being evicted overnight. July, 2024: The Supreme Court directs the state government to submit a rehabilitation plan for the affected residents. September, 2024: Supreme Court allows Uttarakhand government’s request for two more months time to finalise a rehabilitation policy for those likely to be affected. December 2, 2025: Supreme Court defers verdict to December 10, amidst the situation in Haldwani.
The Railways claims they have maps, a notification of 1959, revenue records from 1971 and the results of the 2017 survey to prove their ownership of the land.
Spread over a 2.2 km strip of land, the affected area covers the slums of Gafoor Basti, Dholak Basti and Indira Nagar – all falling under Banbhoolpura area of Haldwani — and is home to at least three government schools, 11 accredited private schools, 10 mosques, 12 madrassas, one government public health centre and one temple.

The families have claimed that the names of local residents are entered in the municipal records of the house tax register and that they have been paying house tax regularly for years.
They claim that they have been living there for generations pointing out that a notification of 1959 by Railways, revenue records from 1971 and the results of the 2017 survey prove their ownership of the land.
