Gauhati High Court grants bail to man accused of calling Delhi bomb blast as ‘fake news’

The Gauhati High Court recently granted bail to a man accused of calling the news regarding the recent bomb blast in Delhi as “fake news”.

Justice Sanjeev Kumar Sharma was hearing the bail plea filed by the accused who was booked on the charges of committing a terrorist act (Section 113(3)) and other sections of BNS.

The court observed the nature of the allegation and the period of detention while allowing the bail plea of the accused.

“Having regard to the nature of the allegation and the period of detention, also having due regard to the opinion that the informant has expressed above, the prayer for bail is allowed,” the court said.

The court also ordered that the accused shall not leave the district without prior permission of the chief judicial magistrate, Kokrajhar, Assam.

An FIR was registered against the accused under Sections 113(3) (terrorist act), 152 (acts endangering sovereignty of India), 197(1) (imputations prejudicial to national integration), 352 (intentional insult), 353(2) (statements conducing to public mischief) of the Bharatiya Nyaya Sanhita, 2023.

In the FIR, it was alleged that the accused had made a comment i.e. “fake news” in response to a news regarding the recent bomb blast that took place in Delhi near the Red Fort.

The FIR stated that such activities indicated his intent to promote enmity between different groups within the society, which may cause communal tension and disturbances, thereby endangering the sovereignty and integrity of India.

The accused was arrested on November 13, 2025 and spent 13 days behind the bars.

While granting bail, the court said, “the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000 with two surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kokrajhar, Assam.”

The court directed that the accused shall co-operate with the investigation and not try to influence the witnesses or tamper with the evidence.
