While the video of the incident has gone viral, the reason behind the alleged attack on the lawyer is not yet known.

Speaking to The Indian Express, Kishore recounted the incident and said, “A young advocate, probably around 35 or 40 years old, attacked us with his slippers. Then we left from there. And they also said that they were punishing us for throwing a shoe at the Chief Justice of India. They also said that he was a Dalit and that’s why they threw the shoe at him. Then we also chanted ‘Sanatan’ slogans.”

While Kishore denied having sustained any injuries, he said it was “all within the family”, when asked whether he had filed a complaint with the police.

“We didn’t file a complaint. What’s the point of complaining against lawyers? They are all our own brothers. It’s just a small matter within the family,” he added.

Advocate Deepak Kumar from Karkardooma district courts told The Indian Express, “I learnt about the incident after I came out of a hearing from a courtroom. My colleagues told me that the lawyer who had hurled a shoe on former CJI BR Gavai got involved into verbal and physical scuffle with some lawyers here.”

Shoe hurled at CJI

The incident occurred during mentioning hours on October 6, when the CJI was sitting with Justice Chandran. Though Kishore, 71, was briefly detained, he was released later that day after the CJI instructed the court’s Registrar General not to press charges.

In his first reaction to the incident after a lawyer in his seventies allegedly hurled a shoe toward him inside his courtroom earlier in the day, Gavai told The Indian Express that he asked the lawyer arguing before him to “just ignore it”. “I am not distracted by all this. You also don’t be distracted and proceed further with the case,” he said Monday afternoon, recounting his immediate response to the incident that took place during mentioning hours in Court No. 1.

Former CJI Gavai, who appeared unruffled, said nothing landed on him or his desk. “I only heard the sound. Maybe it fell on some table or somewhere,” he told this newspaper, adding, “I only heard him say ‘maine Gavai saab ke taraf pheka tha’. Perhaps what he threw landed somewhere else and he was trying to explain.”
The man, identified later as Advocate Rakesh Kishore, was quickly escorted out by security personnel.
