The Chhattisgarh High Court has upheld the judgment of a family court that granted divorce to a man, saying that his wife repeatedly threatening to commit suicide and deserting him amounted to cruelty.

A two-judge Bench was hearing a case filed by a 28-year-old woman against the family court’s ruling.

The couple were married in 2018 and have a three-year-old son. Following a marital discord between the couple, in 2019, the woman allegedly attempted suicide by trying to set herself ablaze. While the husband alleged his wife repeatedly attempted suicide and deserted him, she made domestic violence and mental torture allegations against the husband and her in-laws.

Citing previous apex court judgements, a bench of Justices Rajani Dubey and Amitendra Kishore Prasad said, “In the present case also, it is quite evident that the wife/appellant threatened her husband/respondent by making repeated attempts to commit suicide and it is also quite evident that since the year 2020, the appellant/wife is living separately from her husband/respondent and looking to the conduct of the wife, it is not possible for husband to live with her…”

The High Court said the family court had rightly found “that the appellant/wife has committed cruelty with the respondent/husband and she deserted him, therefore, learned Family Court has granted decree of divorce in favour of the respondent/husband”.

The judges, however, told the husband to pay a permanent alimony of Rs 10 lakh to her wife, noting that this would “serve the purpose of equity and meet the ends of justice”.

“This amount shall cover all the pending and future claims of the appellant/wife against the respondent/husband. The respondent/husband is, therefore, directed to pay the said amount as permanent alimony to the appellant/wife within a period of four months from today,” the court said.
