A civil judge in Dhalai who was accused of sexually assaulting a rape survivor when she went to his chamber to record her statement has been transferred to the High Court of Tripura and kept on “compulsory waiting” for posting. The judge was also directed to report to the HC immediately.
A notification issued by Tripura High Court Registrar General Vishwajeet Pandey three days after the woman’s complaint said the civil judge “is hereby transferred to the High Court and is kept on compulsory waiting for future posting”.
A senior official of the state police earlier said that the woman was allegedly raped by a 26-year-old man at her residence on February 13. She was summoned to the judicial magistrate’s office for her testimony on February 16, when the judge allegedly victimised her.
A three-member panel, headed by the district and sessions judge, was then formed to investigate the incident. The panel comprising Dhalai District and Sessions Judge Gautam Sarkar, Chief Judicial Magistrate Satyajit Das and others visited the accused judge’s office to investigate the matter.
In her written statement available with The Indian Express, the woman alleged that the magistrate groped her and molested her. “I was summoned to record my statement under 164 (5) as a victim in the chamber of the First Class Judicial Magistrate. After I reached there, the judicial magistrate asked me to go in his chamber alone and asked the woman police personnel to stay outside,” the statement said.
“The judge closed the door behind me and asked me to narrate what happened to me. I gave statements on the rape on me when he asked me to stand up and groped me and sexually assaulted me,” she said in the affidavit submitted to the office of the Additional District and Sessions Judge.
The woman also accused the judge of digitally raping her, claiming that it was part of the court’s procedure. She revealed her ordeal to her husband who consulted lawyers and lodged a complaint with the Bar Association. “I’m a humble daily wager. If a judge like him mistreats us, where would people go for justice,” he said.
