SC drops Shehla Rashid, Shah Faesal as petitioners challenging Article 370 abrogation

(Express file photo by Shuaib Masoodi) The Supreme Court Tuesday allowed the deletion of names of activist Shehla Rashid Shora and bureaucrat Shah Faesal from the list of petitioners challenging the abrogation of Article 370 and the downgrading of Jammu & Kashmir state into two Union Territories.
A Constitution Bench of the apex court, headed by Chief Justice of India (CJI) D Y Chandrachud, posted the hearing of pleas against the abrogation on August 2. It said that the hearing would start at 10:30 am and proceed on a day to day basis.

On August 5, 2019, the Centre issued an order amending The Constitution (Application to Jammu and Kashmir) Order, 1954, and superseding it with The Constitution (Application to Jammu and Kashmir) Order, 2019. The new order made “all the provisions of the Constitution” applicable to J&K state. The government also amended Article 367 to add a new Clause (4), making the Constitution of India directly applicable to J&K.
On August 6, the President issued a declaration under Article 370(3) making all its clauses inoperative except the provision that all articles of the Constitution shall apply to J&K.
Rashid and Faesal were among the 23 petitioners who had moved the SC in 2022, challenging the Union government’s 2019 decision.
