In a legal victory establishing the uniqueness of the century-old business of a shop here,a court has ruled that only it can use the name ‘Iruttukadai halwa’ for the famous sweet dish made of wheat and sugar.
Allowing a petition by Sulosanabhai (69),whose forefathers started the halwa business here in 1900 after migrating from Punjab,a fast track court ordered that barring the original shop at Amman Sannathi Street all other shops selling halwa should not use the name ‘Iruttukadai’ (dark shop).
The poorly illuminated shop,which has no name board,sells hundreds of kilograms of halwa daily and is open only in the evenings. Their entire stock of halwa,made in the day,is sold on that night itself within hours of its opening.
Sulosanabhai submitted her shop was a unique one. Her father-in law started it here in 1900 selling only halwa. The shop was called ‘Iruttukadai halwa shop’ because the sweet was sold only between 5 pm and 9 pm and the name ‘Irruttukadai’ became a brand.
Even now the shop continues to be poorly illuminated with the business carried out with the help of a 40 watt bulb and a huge crowd throngs it every day.
But over the years,a few other shops,including one started in 2007,were marketing the sweetmeat under the name ‘Iruttukadai halwa’,affecting her business,she said.
Judge Pon Prakash held that no other shop except the original one should not use the name ‘Iruttukadai halwa’ in any form.
“Others should not use the name in printed form or for advertising. Apart from this,the name ‘Iruttukadai halwa’ should not be used in any manner with any other words in their shop names,” the judge held.
Sulosanabhai submitted 27 documentary evidences to prove her case for the brand name of ‘Iruttukadai halwa’,which is in great demand from places far and near.
