Refusing sanction to prosecute public servant should be a reasoned one: Bombay HC

In an order dated October 5, the DGP whose sanction is required to prosecute police officials under the anti-corruption Act, gave sanction to prosecute the two constables while refusing to grant sanction to prosecute Hire.

OBSERVING THAT an order refusing sanction to prosecute a public servant should be a reasoned one, the Aurangabad bench of the Bombay High Court set aside an order by the Maharashtra Director General of Police (DGP) refusing to grant sanction to prosecute a police inspector on charges of corruption. The court, last week, directed the DGP to reconsider the order refusing sanction observing that there was sufficient material against the police inspector under provisions of Prevention of Corruption Act.

“It needs to be kept in mind that the authority is expected to act upon the material and if the material makes out a prima facie case, giving of sanction cannot be avoided. It also needs to be kept in mind that the sanction and its procedure is not there to shield the guilty,” the division bench of Justices T V Nalawade and M G Sewlikar said, while remanding the matter back to the DGP for reconsideration.
