The Rashtravadi Janata Party, a “registered political party”, has approached the Supreme Court seeking postponement of Bihar Assembly elections to March 2021 in view of the Covid-19 pandemic and flood in the state.

The plea urged the court to direct the Election Commission of India to “postpone” the Bihar election scheduled in October-November and stated, “It will be better for the safety of the people to hold the said election sometime in the month of March 2021, when the situation in the state is somewhat normalised so that citizens can participate and cast their votes safely and without there being any threat either of pandemic or the flood”.

On August 28, the SC had refused to entertain a plea by one Avinash Thakur, who had sought postponement of the Bihar elections on the ground of Covid-19, and noted that the pandemic cannot be a ground for deferment.

The court also observed that the plea was premature, as the notification for the polls had still not been issued.
