Winter session of Parliament Day 15 Live Updates: Trinamool Congress MP Mahua Moitra’s reference to the death of judge B H Loya “long before his time” created uproar in Lok Sabha on Friday as Union minister Kiren Rijiju accused her of raising a matter settled by the Supreme Court, and warned of “appropriate parliamentary action”. Participating in a debate on 75 years of the Indian Constitution, Moitra made a passing, but contentious, remarks on Loya’s death as she attacked the ruling BJP for allegedly targeting institutions and opposition leaders to silence critical voices. The House was adjourned briefly twice due to the uproar over the matter. Rijiju said, “We will take appropriate parliamentary action. You cannot escape. You are setting a very wrong precedent.”

Earlier in the day, Union Minister Rajnath Singh initiated a debate on the Constitution in Lok Sabha and slammed the Opposition saying attempts have been made to project that a single party contributed to the document. Singh also said that the grand old party tried to destroy the basic principles of the Constitution.  Meanhwhile, during her maiden speech in Parliament, Congress MP Priyanka Gandhi took a swipe at the BJP saying the Centre favours Adani and all airport, road and rail projects are being given to one person. Gandhi also said there is sense of fear in the society and journalists, professors, farmers are being attacked. However, those who instill fear are afraid even to hold debates, give reply, Gandhi said.

Rajya Sabha adjourned: Opposition MPs have moved a notice in Rajya Sabha seeking impeachment of Allahabad High Court judge Justice Shekhar Yadav over his controversial statement against minorities. Citing Rajya Sabha rules, Vice President Jagdeep Dhankhar declined four notices submitted today. Chaos erupted in the Upper House as both Opposition MPs and BJP MPs traded barbs over farmers issues, no-confidence motion against Dhankhar and Rajya Sabha was adjourned for the day.

BJP member Nishikant Dubey on Friday accused TMC MP Mahua Moitra of insinuating the death of judge B H Loya. The BJP leader raised the issue right after her speech was over.

He also objected to her criticism of former chief justice of India D Y Chandrachud, who recently retired, for a host of reasons, including receiving Prime Minister Narendra Modi at his residence during the Ganapati festival.

Union Minister Rijiju also said that the case was settled, the TMC MP's remarks are very serious and there is no question of any link or interference.

The Supreme Court, while hearing some pleas, had ruled out any foul play in the death of Loya, saying he had died of natural causes.

His death in 2014 had created a major row following a media report alleging foul play, as he was hearing a politically sensitive case. After looking into the matter, the apex court had said there was no merit in PILs alleging foul play, PTI reported.

Rijiju, also the parliamentary affairs minister said, "We will take appropriate parliamentary action. You cannot escape. You are setting a very wrong precedent." Speaker Om Birla said he will look into the records.

Winter session of Parliament Day 15 Live Updates: Why Constitution debate is held today ?

The debate on Constitution is set to be held today to mark the beginning of the 75th year of its adoption. The Constituent Assembly adopted the Constitution of India on November 26, 1949 and it came into effect on January 26, 1950.

While January 26 is celebrated as Republic Day, since 2015, November 26 is annually observed as the Constitution Day of India, or Samvidhan Divas. The Constituent Assembly, the body meant to draft the Constitution of India, held its first session on December 9, 1946, attended by 207 members. Initially, the assembly had 389 members, but after Independence and the Partition of India, the strength was reduced to 299.

The assembly took over three years to draft the constitution, spending over 114 days considering the content of the draft alone. A range of sources were consulted for the draft, including the Constitutions of other countries, and suitable amendments were made to adapt the provisions to what India needed at the time.

Another major source was the Government of India Act of 1935. It introduced bicameralism — upper and lower Houses — at the Centre and in six provinces along with direct elections to these chambers. At the time, it was one of the longest pieces of legislation passed in the British Parliament. On December 13, 1946, Nehru moved the “Objectives Resolution” that was later adopted as the Preamble on January 22, 1947, to encapsulate the basic philosophy of the Constitution.
