Supreme Court extends interim bail of Alt News co-founder Mohammed Zubair till further orders

After Additional Solicitor General S V Raju, appearing for Uttar Pradesh, sought more time to file the counter-affidavit in the case, the bench granted the UP government four weeks’ time.

The Supreme Court on Tuesday extended the interim bail granted to Alt News co-founder Mohammed Zubair till further orders in a case in which he was booked by the Uttar Pradesh Police in Sitapur for hurting religious sentiments through tweets in which he called some Hindu seers “hate mongers”.

A bench of Justices D Y Chandrachud and A S Bopanna, which took up his plea seeking quashing of the Sitapur FIR, was told by Additional Solicitor General S V Raju appearing for the state that Zubair had already been granted interim bail by the court on July 8 and the state would need some more time to file its counter-affidavit.

Senior advocate Colin Gonsalves, who appeared for Zubair, pointed out that the interim relief was only for five days and would expire on Tuesday. The bench then granted the Uttar Pradesh government four weeks’ time to file its response and also extended the interim bail. The court will hear the matter again on September 7.

Earlier on July 8, Justices Indira Banerjee and J K Maheshwari had directed that Zubair’s plea be listed before a regular bench. Issuing notice, it also granted him five days’ interim bail on the condition that he shall not tweet or tamper with electronic evidence.

As Zubair is facing multiple cases, the court clarified that it was giving him bail only in the case before it.
