Justice Akil Kureshi elevation to Tripura High Court cleared

Sources said the official notification of the appointment, to be issued by the Department of Justice under the Union Law Ministry, will be issued soon.

Almost five months after the Supreme Court collegium recommended his elevation as a Chief Justice of a High Court, President Ram Nath Kovind on Thursday issued the warrant appointing Justice Akil Kureshi as the Chief Justice of the Tripura High Court, The Indian Express has learnt.

Sources said the official notification of the appointment, to be issued by the Department of Justice under the Union Law Ministry, will be issued soon.

The Centre’s move to clear the file elevating Justice Kureshi comes after Solicitor General of India Tushar Mehta had on Monday told a Supreme Court bench headed by Chief Justice of India Ranjan Gogoi that one more week was “needed for administrative measures”.

The collegium, comprising the CJI and Justices S A Bobde and N V Ramana, had on May 10 recommended that Justice Kureshi, the “senior-most Judge from Gujarat High Court”, be appointed Chief Justice of Madhya Pradesh High Court.

However, the government referred the proposal back to the CJI through two communications dated August 23 and 27 along with “accompanying material”.The collegium went through them and on September 5, recommended Justice Kureshi’s elevation as Chief Justice, this time of the Tripura High Court.

Meanwhile, with the Centre delaying Justice Kureshi’s elevation despite the collegium’s recommendation, the Gujarat High Court Advocates’ Association moved the apex court. The lawyers’ body termed the Centre “withholding the appointment” despite the May 10 recommendation of the collegium as “arbitrary inaction”.

On Thursday, the SC bench said that it will hear the matter related to the implementation of the decision of the collegium by the Centre on the elevation of Justice Kureshi on November 13.

The bench, comprising CJI Gogoi and Justices Deepak Gupta and Sanjiv Khanna, said the matter will be listed next week, and Justice Bobde — the chief justice-designate — would be a part of the two-member bench headed by CJI Gogoi.

“Post the matter November 13, 2019, before a Bench comprising of The Chief Justice and Justice S A Bobde,” the bench said.
