The Punjab and Haryana High Court Friday issued notices to Commissioner of Police,Jalandhar,Gaurav Yadav,asking him to explain why contempt proceedings be not initiated against him for not registering an FIR against former Punjab minister Avtar Henry.
The court had,on December 19,2012,directed Yadav to register an FIR against Henry on charges of cheating,criminal conspiracy and under the Passport Act if allegations levelled against him were found to be prima facie correct. Ajay Sehgal had petitioned the court demanding registration of FIR.
The HC had directed Yadav to investigate into the matter. The entire action into the complaint was directed to be completed within two months.
Pursuant to the court directive,the Commissioner passed an order on February 18 wherein he concluded that Henry had contested Assembly elections in the years 1986,1992,1997,2002,2007 and 2012 by concealing the factum of termination of his British Citizenship,by submitting affidavit to the effect that he was a citizen of India.
However,instead of ordering registration of FIR against Henry under section 125-A of the Representation of People Act,Yadav disposed of the complaint with the observation that a copy of the order is being forwarded to the Regional Deputy Director,Urban Local Bodies,Jalandhar with a request to take legal action.
The Commissioner had observed that further action shall be taken by the Passport Officer,after receipt of reply from Ministry of External Affairs. The petitioner alleged that Yadav also avoided taking action against Henry under The Foreigners Act.
Yadav has been asked to file his response by May 17.
