Odisha ex-MP files case against CM Naveen Patnaik alleging ‘criminal conspiracy’

Former BJP MP Kharavela Swain lodged an FIR against Naveen Patnaik and the director of the Vigilance Department alleging criminal conspiracy against the CRPF DG Prakash Mishra.

A week after the Odisha High Court quashed an FIR against CRPF director-general Prakash Mishra, former BJP MP Kharavela Swain lodged an FIR against Chief Minister Naveen Patnaik and the director of the Vigilance Department Kanwar Brajesh Singh on Saturday alleging criminal conspiracy against the IPS officer.

On June 19, the Odisha HC had quashed the state vigilance case against Mishra, who is also former director general of police, noting that there was no prima facie case against him and that the vigilance director did not “ensure free and fair investigation before registering a case”.

“It’s not uncommon that honest officers are victimised by political establishments,” Justice S C Parija had said.

In September last year, the Vigilance Department had registered a case against Mishra, alleging that during his tenure as the CMD of the Orissa Police Housing and Welfare Corporation, in 2009, advance payments of Rs 59 crore were given to certain steel and cement suppliers against existing rules.

Swain, who is also Utkal Bharat chief, lodged the FIR against the CM and vigilance director at the Capital police station here, alleging that the State Vigilance Department had deliberately and willfully registered a one-sided case.

The HC had said that the vigilance authorities proceeded in the matter with a predetermined agenda to implicate Mishra, irrespective of whether any material was available to substantiate the allegations. The method adopted by the Vigilance in concluding the inquiry post-haste, without verifying relevant documents and examining any witness, smacks of arbitrary and malafide exercise of power with the motive to harass and damage the petitioner’s reputation.

Swain alleged that despite this stinging rebuke, the government has not taken any action against the director.
