Advocate general Darius Khambata, however, denied Tuesday the state did not oppose bail to the accused. He said the public prosecutor had pointed out in the sessions court that the alleged offences were under sections pertaining to molestation and provisions of Protection of Children from Sexual Offences Act,2012.

The bench of justices Mohit Shah and M S Sanklecha is hearing a suo motu public interest litigation based on a newspaper report that claimed inmates of the home were sexually attacked. The report claimed the inmates were tortured by the shelter staff — they were forced to bathe with doors open and their private parts touched. The case has now been posted for hearing on Thursday.
