Haryana appoints judge with ‘doubtful integrity’ as Deputy AG

These were the damning remarks recorded by a senior High Court Judge in the annual confidential report (ACR) of a Haryana lower Court Judge,taking note of which his services were dispensed with on December 4,2012.

“Integrity doubtful and C below average”.

These were the damning remarks recorded by a senior High Court Judge in the annual confidential report (ACR) of a Haryana lower Court Judge,taking note of which his services were dispensed with on December 4,2012.

Now,despite a clear indictment and adverse remarks against former judge Ankur Lal,the Haryana government has appointed him as a law officer in the state Advocate General’s office. An appointment letter appointing him as Deputy Advocate General was issued to Lal on May 7 by the state government.

Incidentally, Haryana Advocate General,Hawa Singh Hooda,seemed unaware about the development.

“I am not aware of this (the new appointment) but I will certainly look into it,” the Advocate General said,adding that appointments to the AG office are made by the government.

It was in the year 2010-2011 when Justice Jasbir Singh,acting Chief Justice and the then Administrative Judge of Gurgaon,had recorded adverse remarks on the conduct and working of Lal,who was posted as Civil Judge (Junior division) in Gurgaon. Lal was graded as “C below average”. He was then transferred to Bhiwani. Aggrieved,Lal moved a representation requesting the High Court to expunge the remarks against him.

The issue was considered by a committee of High Court Judges on the administrative side. Lal’s request was turned down by the Committee on September 22,2011. His ACR for the year 2010-2011 was recorded as C and his integrity was dubbed as doubtful after which in December 2012 his services were dispensed with.

However now,the Haryana government has appointed him as Deputy Advocate General (DAG),a post which draws a salary of Rs 85,000 per month.

The Haryana AG,meanwhile,said that “propriety demands that he (Lal) should have disclosed himself about his ACR”.

What the Full court said

A copy of the representation and the decision of the 23rd Full Court meeting of judges of the year 2011,held on Thursday,September 22,2011 at 4 pm reads: “The report of committee be accepted and the representation dated August 12,2011 made by Ankur Lal,Civil Judge (Junior Division)-cum-Judicial Magistrate (First Class) for expunction of adverse remarks recorded on his work and conduct for the year 2010-2011 by Justice Jasbir Singh,administrative Judge of Gurgaon sessions division be rejected and his annual confidential remarks for the year 2010-2011 be recorded as C below average-Integrity doubtful”.
